We at Timberline (“Timberline”, “we”, “our”, “us”) protect the Personal Information you provide us in accordance with this Privacy Policy. We have prepared this Privacy Policy to let you know how we collect, use, disclose and otherwise manage the Personal Information you provide to us through any Timberline customer call centers (the "Customer Call Centers"), through any physical mail or email sent to Timberline ("Mail"), through the https://www.timberline-amana.com/ website and other sites that may currently exist and/or be established by Timberline (collectively the "Sites").

If you do not agree with this Privacy Policy, you may choose not provide any Personal Information. However, if you choose not to provide Personal Information, you may not be able to do certain things like access particular areas of our website, participate in sweepstakes, request information or send Timberline an email.

A. Collection and Use of Personal Information

As used in this Privacy Policy, “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household. This information includes, but is not limited to identifiers such as real name, alias, postal address physical address, telephone number, credit card information, screen name and email address. This information also includes, as required by applicable law, commercial information, including records of products or services purchased, obtained, or considered, or other purchasing or consuming histories, and inferences drawn from any of the above information.

Timberline may collect and use Personal Information that you provide us when you (i) Purchase, order, attempt to return, attempt to exchange, register or request certain information about Timberline’s products and services; (ii) Request warranty or tax exempt information; (iii) Contact a Customer Call Center or customer service desk; (iv) Visit, register on, post to or participate in the features of one of Timberline’s Sites; (v) Open an account or, if applicable, enter into a contest or sweepstakes, join a club or participate in a program offered by Timberline; (vi) Respond to one of Timberline’s surveys; (vii) Provide Timberline with comments or suggestions; (viii) Provide Timberline with any information contributed to our Sites on your behalf; and/or (ix) Provide Timberline other information.

When you use one of the Timberline Sites, certain additional information is collected without you being prompted to provide it. This information includes, but is not limited to, cookies which are covered below.

A note about “Phishing” attacks: Timberline does not send emails requesting you to validate account password information or personal information such as credit card numbers. If you do receive an email that appears to come from Timberline and asks for this type of information please forward the email directly to Timberline and then delete from your inbox.

1.Customer Call Centers

When you call one of Timberline’s Customer Call Centers, you may be asked for information that identifies you along with additional information we need to help us promptly answer your questions such as your name, email information, mailing address and a telephone number. Timberline may retain this information to assist you in the future or for its other business needs, as permitted under this Privacy Policy and applicable law.

2. Online Registration/Newsletters/Offers/Coupons

(a) Information Timberline Requests. Registration and/or club or program membership is an optional service that may be provided by Timberline. You do not have to register or join to browse online. When you register or join, you are asked for certain Personal Information which may be used to assist us in our provision of services.

  

(b) Newsletters/Offers/Coupons. If such service is offered when you register or join, you will have the opportunity to receive future marketing information from Timberline and to sign up for email newsletters, coupons and offers that cover certain subjects that are of interest to you. These newsletters, coupons and offers will be sent to you only if you choose to place your name on our mailing list. In order for us to deliver these newsletters, coupons and offers, Timberline may need to pass along your name and email address to the Service Providers who supply us with email service and who authenticate and validate the information you provide.

3. Non-Voluntary Information; Personalized Advertising

(a) General Tracking Information. Our Sites collect information through a number of different technologies, including cookies and Web beacons. Cookies, web beacons and other technical methods may involve the transmission of information either directly to us or to another party authorized by us to collect information on our behalf. Among other things, Timberline keeps records of the pages visited by each site user. Timberline aggregates this information with data on the pages visited by other users to track overall visitor traffic patterns. Timberline uses this information to improve its Sites and to develop functions and user tools which will make it more responsive to the needs and preferences of Timberline customers.

(b) Cookies and Web Beacons. Timberline websites use a technology called “cookies.” A cookie is an element of software code that Timberline Sites can send to your browser, which is then stored on your hard drive so we can recognize you when you return. Should you decide not to accept cookies from our Sites, you will limit the functionality we can provide when you visit our Site. Third parties may place cookies on your browser and may send their own cookies to your cookies file, which may allow personalized retargeting technology and service of personalized banners to enhance your shopping experience. The Network Advertising Initiative (NAI) consumer opt-out page currently located at www.networkadvertising.orglmanaging/opt_out.asp permits you to opt-out of behavioral advertising with some of the third parties whose cookies may be placed on your browser when you visit our Sites. Web beacons are small pieces of data that are embedded in images on the pages of Web sites.

  

(c) Other Automatic Information. We may collect additional automatic information about your visit to our Site or contacts with us, such as time of day, browser type and version, browser language, your operating system and platform, and the Internet Protocol (lP) address used to connect your computer to the Internet. This information is used for analytical purposes and to help us provide services to our customers. We may also use this information to administer and troubleshoot our Sites and services.

   

(d) Emails. In e-mails that we send our customers, we may use technology for a variety of purposes, including, without limitation, determining whether our customers have opened or forwarded those e-mails and/or clicked on links in those e-mails, customizing banner advertisements and other messages after a customer has closed the e-mail, and determining whether a customer has made an inquiry or purchase in response to a particular e-mail. These technologies may enable us to collect and use information in a form that is personally identifiable.

  

(e) Aggregate Information. On occasion, we may provide aggregate information (which shall not include personally identifiable information) to vendors, investors, potential advertisers, or news agencies to demonstrate the amount of interest in our Site and to help us plan for technical infrastructure requirements.

B. Timberline’s Additional Use of Personal Information

1. Research and Marketing

To better serve you, we may combine the Personal Information that you provide with publicly available information and information we receive from or cross-reference with our marketing partners and others. Timberline uses that combined information to enhance and personalize our products and services, to communicate with you about our products and events that may be of interest to you, and for other promotional purposes.

2. Third Party Products and Services

We may share your Personal Information about Timberline consumers with third parties so that they may provide you with information about products and services and special offers. These third parties are not authorized by us to use your Personal Information in any other way. Timberline does not sell your Personal Information.

3. Service Providers

Some of our operations, such as our Customer Call Centers, may be managed by unaffiliated companies. These companies may have access to your Personal Information on a confidential basis only to the extent necessary to perform their functions.

4. Legal Disclosure; Business Transfer

Timberline must provide your Personal Information in response to a search warrant or other legally valid inquiry or order, or to an investigative body in the case of a breach of an agreement or contravention of law, or as otherwise required by law. In the event of a bankruptcy or sale, merger or acquisition, Timberline may transfer your Personal Information to a separate entity. That entity will be responsible for ensuring that your Personal Information is used only for authorized purposes consistent with this Privacy Policy.

5. Third Party Links, Data and Content Serving

Timberline’s Sites may include links to the websites of our business partners, vendors and advertisers and content served by third parties. The inclusion of any link does not imply Timberline’s endorsement of any other company, its websites, or its products and/or services. These linked websites have separate and independent privacy policies, which we encourage you to read carefully. We have no control over such websites and therefore have no responsibility or liability for the manner in which the organizations that operate such linked websites may collect, use or disclose and otherwise treat your Personal Information. We may also provide your information to our affiliated companies and successors. We reserve the right to provide third parties with aggregate statistics about our clients, traffic, viewing and purchasing patterns and other site information. This data reflects site usage patterns, but does not contain personally identifiable information about any individual user. In certain circumstances, we may share your information with service providers that need access to your information to provide operational or other support services. To ensure the confidentiality and security of your information, service providers must agree to safeguard your information in confidence.

6. Information Collected from Third Parties

We may update or supplement Personal Information collected directly from you with other information obtained from third parties. In addition, Timberline may obtain Personal Information about individuals who are not yet users of our Site or services. When Timberline associates information that it obtains from third parties with Personal Information collected under this Privacy Policy, we will treat the acquired information like the Personal Information that we collected ourselves and, except as permitted by this Privacy Policy, the Personal Information will not be shared with third parties.

C. Privacy Preferences/Opt-Out

If at any time you would like to be removed from any/all Timberline marketing lists, newsletters, distribution lists, or the like, you may do so by contacting us in any of the ways identified in Section H. Please remember to include your email address, name, mailing address and telephone number in any request. The best way to opt-out is to use the link at the bottom of email messages you receive. That tool provides a one-click confirmation opt-out. If you choose not to use that link, you may also send an email request to us with the word “REMOVE” in the subject line and your email address in the body. This secondary method may take up to 30 days to remove your address from the file.

D. California Privacy Rights

1. Shine the Light

Effective January 1, 2005, under California Civil Code Section 1798.83, if an individual who is a California resident has provided Personal Information to a business in connection with a business relationship that is primarily for personal, family, or household purposes, and if that business has within the immediately preceding calendar year disclosed such an individual's Personal Information to a third-party and knows or should have known that such third-party used the information for its own direct marketing purposes, then that business is obligated to disclose in writing to such individual upon request, what Personal Information was shared and with whom it was shared. Any request for a disclosure required under this California law should be sent to us via email or via regular mail at the address set forth below in Section H. Please note that under this law, we are not required to respond to a customer's request more than once in a calendar year, nor are we required to respond to any request that is not sent to the email or mailing address designated above. We will disclose and deliver the required information free of charge within 45 days of receiving your verifiable request. The time period to provide the required information may be extended once by an additional 45 days when reasonable necessary and with prior notice.

2. Do Not Track

Section 22575 of the California Business & Professions Code requires website and online service operators to disclose whether they honor web browser "Do Not Track" settings. We support and honor "Do Not Track" web browser settings. If you enable Do Not Track settings in the browser you are using, we will not collect, store, or use information about websites you visit using that browser other than https://www.timberline-amana.com. Other parties, however, may not honor Do Not Track signals. These parties may collect Personal Information about your online activities over time and across different websites when you visit the Site, for example by using cookies on our site. We have no access to or control over other parties' information collection practices, even those with which we may have an affiliation. 3. Your Rights under the CCPA

  • The right to say “no” to the sale of Personal Information. You also have the right to ask the Company not to sell Your Personal Data to third parties. You can submit such a request by clicking our "Do Not Sell My Personal Information" link on our cookie banner or by visiting the cookie settings section in our site footer.
  • The right to know about Your Personal Information. You have the right to request and obtain from the Company information regarding the disclosure of the following:
    • The categories of Personal Information collected
    • The sources from which the Personal Information was collected
    • The business or commercial purpose for collecting or selling the Personal Information
    • Categories of third parties with whom we share Personal Information
    • The specific pieces of Personal Information we collected about you
  • The right to delete Personal Information. You also have the right to request the deletion of your Personal Information that have been collected in the past 12 months.
  • The right not to be discriminated against. You have the right not to be discriminated against for exercising any of your Consumer's rights, including by:
    • Denying goods or services to you
    • Charging different prices or rates for goods or services, including the use of discounts or other benefits or imposing penalties
    • Providing a different level or quality of goods or services to you
    • Suggesting that you will receive a different price or rate for goods or services or a different level or quality of goods or services

Certain information may be exempt from such requests under applicable law. For example, we need certain types of information so that we can provide services to you. If you ask us to delete it, you may no longer be able to access or use services.

Please provide your full name and e-mail address so that we may respond to your request as quickly as possible. You will be required to verify your identify before we fulfill your request. To do so, you will need to provide us with certain account information, such as your full name and email address. You can also designate an authorized agent to make a request on your behalf. To do so, you must provide us with written authorization for the agent to act on your behalf. You will still need to verify your identity directly with us. To opt out of the "sale" of your Personal Information visit the "Do Not Sell My Personal Information" section on our Site.

E. Children’s Privacy Policy

Timberline does not sell products for purchase by children. If you are under 18, you may use timberline-amana.com only with the involvement of a parent or guardian. Timberline does not intend to collect any personally identifiable information from children through the Timberline Sites. Please do not allow children under the age of 18 to provide any personally identifiable information related to our Sites. If we determine that a child under 18 has provided Personal Information in violation of this policy, we will make every reasonable effort to delete that information as soon as practical. If you become aware that such information has been provided by a child under 18, please notify us by contacting Timberline. Please be certain to include in the subject line Privacy Policy Request.

F. Security Limitations

No data transmission over the Internet can be guaranteed to be 100% secure. While we strive to protect your Personal Information from unauthorized access, use or disclosure. Timberline cannot and will not ensure or warrant the security of your Personal Information.

G. Cross-Border Data Transmission.

We are headquartered in, and our primary data storage and processing facilities are in the United States of America (“USA”). If you are accessing our Site or services from another country, please note that all data we collect will be transmitted outside of your country and into the USA, where it will reside and be processed. In addition, we may process or store your data in countries beyond your country and the USA. By continuing to access this Site, or by providing your Personal Information, you explicitly consent to have your data so processed and stored.

Any updates to our Privacy Policy will be posted on this page so that you are always aware of what information we collect, how we use it, and under what circumstances we disclose it. Continued use of our Sites, Customer Call Centers or other Timberline services following our posting of the change will constitute binding acceptance of those changes.
